1. Introduction

This Privacy Policy explains how GuestMate, LLC, a company registered in the State of Florida ("GuestMate," "we," "us," or "our"), collects, uses, shares, and protects your personal information when you use the GuestMate mobile application (the "App").

This policy is designed to comply with:

  • The Florida Digital Bill of Rights (FDBR)
  • The California Consumer Privacy Act (CCPA/CPRA)
  • The European Union General Data Protection Regulation (GDPR)

By downloading, accessing, or using the App, you agree to this Privacy Policy. If you do not agree, please discontinue use of the App.

2. Information We Collect

We may collect the following categories of personal data when you use the App:

  • Identifiers: Name, phone number, email address, account login details.
  • Reservation Information: Booking details and related activity.
  • Device & Usage Data: Device type, operating system, IP address, and in-app activity.
  • Sensitive Data (only if voluntarily provided): Geolocation, voice or image data, or information identifying a child user.

We do not intentionally collect data from children under 13. If we become aware we have collected such data, we will promptly delete it.

3. How We Use Your Information

We process your personal data for the following purposes:

  • To provide and manage the services offered through the App
  • To communicate with you about reservations, updates, and support inquiries
  • To improve the functionality, security, and user experience of the App
  • To comply with legal obligations and protect our legal rights

  • Contractual necessity – to provide you with services
  • Legitimate interests – to improve and secure our services
  • Legal obligation – to comply with applicable laws
  • Consent – where required (e.g., sensitive data, marketing)

We do not sell your personal information.

4. Data Sharing

We may share your personal data only in the following circumstances:

  • With service providers and business partners who process data on our behalf under contract
  • For legal or regulatory reasons, if required to comply with law or enforce our rights

We do not sell or share your sensitive personal data.

5. Data Retention

We retain your personal information for a minimum of two years from the date of your last interaction with the App. After that period, we may continue to retain data as long as necessary to:

  • Provide services through the App
  • Comply with legal, regulatory, or contractual obligations
  • Resolve disputes and enforce our agreements
  • Maintain business and security records

When personal data is no longer required for these purposes, it will be securely deleted or anonymized.

Under Florida & California Law (FDBR, CCPA/CPRA), you have the right to:

  • Delete your data
  • Data Portability – request a copy of your data in a usable format
  • Opt-out of:
    • Sale or sharing of your personal information
    • Targeted advertising or profiling
    • Collection or use of sensitive data (e.g., geolocation, biometrics)

Under GDPR (EU), you additionally have the right to:

  • Withdraw consent at any time (where processing is based on consent)
  • Object to processing based on legitimate interests
  • Restrict processing of your data
  • Lodge a complaint with a supervisory authority in your EU country

How to Exercise Your Rights

To exercise your rights, please contact us at 📧 info@guestmate.us. We will respond to your request within 45 days (with a possible 15-day extension). If we deny a request, you may appeal, and we will respond within 60 days.

We will not discriminate against you for exercising your privacy rights.

8. International Data Transfers

If you are located outside the United States, your personal data may be transferred to and processed in the United States. We implement appropriate safeguards (such as Standard Contractual Clauses) to protect your data when transferred internationally.

9. Children’s Data

We do not knowingly collect or process personal data of children under 13 years old (US) or 16 years old (EU/California) without verified parental consent. If we learn that a child’s data has been collected without consent, we will delete it promptly.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you within the App or by email. Continued use of the App after updates constitutes acceptance of the revised Privacy Policy.
